These Terms of Service ("Terms") govern your use of FieldSchedule, a service provided by Creative Integrations LLC ("Company", "we", "us", or "our"). By accessing or using FieldSchedule, you agree to be bound by these Terms.
1. Description of Service
FieldSchedule is a scheduling and business management platform designed for field service contractors including HVAC, plumbing, electrical, and similar trades. The service includes job scheduling, customer management, SMS notifications, and invoicing features.
2. Account Registration
To use FieldSchedule, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
You are responsible for all activities that occur under your account.
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Send spam, unsolicited messages, or harassing communications through our SMS features
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Violate any applicable laws or regulations, including SMS/telemarketing laws
4. SMS Messaging Terms
FieldSchedule provides SMS notification features. By using these features, you agree to:
- Obtain proper consent from recipients before sending SMS messages
- Comply with all applicable laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM
- Honor opt-out requests promptly
- Use SMS features only for legitimate business communications related to scheduled services
Misuse of SMS features may result in immediate account termination.
5. Subscription and Billing
FieldSchedule is offered on a subscription basis. By subscribing, you agree to:
- Pay the applicable subscription fees
- Provide accurate billing information
- Automatic renewal unless cancelled before the renewal date
Prices are subject to change with 30 days' notice. Refunds are provided at our discretion.
6. Data Ownership
You retain ownership of all data you enter into FieldSchedule, including customer information, job records, and business data. We do not claim ownership of your content.
You grant us a limited license to use your data solely to provide and improve the service.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects access. We are not liable for any downtime or service interruptions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVE INTEGRATIONS LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Creative Integrations LLC from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.
10. Termination
You may cancel your subscription at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, you may request export of your data within 30 days.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Dallas County, Texas.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.
